Terms of service

These terms are an agreement between you and Scaleswift Digital Services LLP (“we”, “us”) covering your use of the PokerIQ app and everything in it. By using PokerIQ you accept them. If you do not accept them, do not use the app.

1. Who may use PokerIQ

PokerIQ simulates poker, so you must be at least 18 years old, or older if the law where you live sets a higher age for simulated gambling or for poker. Do not use PokerIQ if that age or those laws exclude you.

2. Your account

PokerIQ creates an anonymous account for your device on first launch so your chips, Poker IQ, and progress are saved without you having to sign up. You may attach a real identity later using Apple, Google, or an email code.

You are responsible for what happens under your account and for keeping your sign-in method secure.

3. What PokerIQ is

PokerIQ is a poker training app. You play No-Limit Texas Hold’em against computer-controlled opponents, and a coach grades each decision you make, explains it, and turns your mistakes into practice puzzles. The characters at the table are fictional and are played by the app, not by other people.

We may add, change, or remove features and content at any time. We aim to keep the service available but do not guarantee uninterrupted access.

Play money only

Your chip balance, Poker IQ, grades, and other progress exist to measure and motivate your practice. They are not property, have no monetary value, and may be reset or changed, for example to correct an error or to rebalance the game.

Grades and Poker IQ are estimates

Grades, recommended plays, and your Poker IQ are calculated from models of poker strategy. They are simplifications, they can be wrong, and they are not a prediction of how you will do at a real table. Practice in PokerIQ does not guarantee that you will win money anywhere.

If gambling stops being fun

4. Subscriptions and payment

How billing works

$PokerIQ offers optional auto-renewing subscriptions. The length and price of each plan are shown on the purchase screen before you buy.
Payment is charged to your Apple ID at confirmation of purchase.
Your subscription renews automatically at the same price and interval unless you cancel at least 24 hours before the end of the current period.
Your account is charged for renewal within 24 hours before the end of the current period.
Any free trial period ends immediately if you buy a subscription during it. Unused trial time is forfeited.
Without a subscription, the app gives you a fresh play-money stack and a free puzzle set each day. A subscription unlocks more, such as rebuys and unlimited puzzle sets. It never buys chips with any value.

Managing and cancelling

You can manage or cancel a subscription in your Apple ID account settings at any time. Deleting the app does not cancel a subscription. Use “Restore purchases” in the app to recover an active subscription on a new device.

Refunds

Purchases are made through Apple, and refunds are handled by Apple under its terms. We cannot issue refunds for App Store purchases directly.

Prices may change. Any change applies from the next renewal after we tell you, and never to a period you have already paid for.

5. Acceptable use

You agree not to:

Copy, resell, or redistribute the content, or use it to build a competing product.
Reverse engineer, decompile, or tamper with the app, except where the law expressly permits it.
Interfere with the service, bypass paid access, or attempt to reach accounts or data that are not yours.
Use automated means to extract content at scale.
Use the app to get help during a real-money game, tournament, or site where that kind of help is against the rules.

6. Ownership

The app, its content, its design, and its trade marks belong to us or our licensors. We grant you a personal, limited, non-transferable, revocable licence to use PokerIQ for your own non-commercial poker practice. Nothing in these terms transfers ownership of anything to you.

7. Privacy

Our privacy policy explains what we collect and why, and forms part of these terms.

8. Disclaimers and liability

To the fullest extent permitted by law, PokerIQ is provided “as is” and “as available”, without warranties of any kind, and we exclude liability for indirect or consequential loss. Our total liability to you for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or ten US dollars.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

9. Ending the agreement

You may stop using PokerIQ at any time and delete your account from You › Settings › Delete account. We may suspend or end your access if you materially breach these terms, or if we are required to by law. Sections that by their nature should survive (such as ownership, disclaimers, and liability) do so.

10. Changes to these terms

We may update these terms. The date at the top of this page changes when we do, and we will tell you in the app if the change is significant. Continuing to use PokerIQ after that means you accept the updated terms.

11. Governing law

These terms are governed by the laws of India, and the courts of India have jurisdiction, except where consumer protection law in your country of residence gives you the right to bring proceedings locally, which it may.

12. Apple

These terms are between you and us alone. Apple is not a party to them and is not responsible for PokerIQ or its content.

Licence: we grant you a non-transferable licence to use $PokerIQ on any Apple-branded device you own or control, as permitted by the App Store Usage Rules.
Support: we are solely responsible for support and maintenance. Apple has no obligation to provide either.
Warranty: we are solely responsible for any warranty, whether express or implied. If $PokerIQ fails to conform to a warranty that applies, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to $PokerIQ.
Claims about the app: we, not Apple, are responsible for addressing any claim by you or a third party relating to $PokerIQ — including product liability, any failure to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
Intellectual property: if a third party claims that $PokerIQ infringes their intellectual property, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
Export: you confirm that you are not located in a country subject to a US Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
Enforcement: Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
